This report, in the form of a consultation paper, sets out proposals for reforming the approach to legal challenges against clinical negligence in the NHS through the NHS Redress Scheme. This would apply where there was an evident shortcoming in NHS care resulting in avoidable harm, and aimed to provide compensation through a quicker, less expensive and less traumatic resolution to claims, discouraging defensive medicine and ensuring patient safety.
